23 Feb ¿What compensation is to be paid on wrongful dismissals after the 2012 labour reform in Spain?
The compensation for wrongful dismissal (despido improcedente) in cases of work contracts that were signed prior to the entry into force of the new Royal Decree (February 12th, 2012) shall be calculated at a rate of 45 days of salary per year of service for the time of provision of services that have been provided prior to the date of entry into force and at a cost of 33 days pay per year of service for the time of provision of services after such date. The resulting compensation amount shall not exceed 720 days of salary, unless the calculation of compensation for the period prior to the entry into force of this Royal Decree is a higher number of days, in which case such amount applies as maximum compensation, but with a top of 42 monthly payments, in any case.
