14 Jan IS IT TRUE THAT IF I RENT MY HOUSE IN SPAIN FOR MORE THAN 5,800 EUROS PER MONTH I HAVE NO OBLIGATION TO COMPLY WITH THE URBAN LEASE LAW?
Well, yes; It’s true. The current Urban Leasing Act (LAU) has, as an exception to the mandatory character of its articles on rental of homes, the leases of so-called luxury or sumptuous homes. In other words, the will of the parties is not restricted by the rules of LAU Art.6 to 28, but these are only supplementary to the clauses that those parties freely agree on.The lease is considered to be of this type when:
– The house has an area of more than 300 m2; Or
– The annual rent agreed at the beginning of the contract is more than 5.5 times the annual Spanish inter-professional minimum wage.
For this exception to the LAU to be applicable, the rental must be for the entire dwelling.
This rule on sumptuous housing is now recovered after being abolished with effect 6th-June-2013, and is applicable to contracts prior to that date and also to those signed between 19th-December-2018 and 23rd-January-2019 and also to all those signed from 6-March-2019 onwards.
The inter-professional minimum wage (SMI) for 2019 has been set at EUR 12,600
