03 Jan Can I claim in Spain the return of my child taken by his mother to another country?
Yes, you can do so as long as the following circumstances are given:
1) that the child resided in fact in Spain at the time of the abduction
2) that you have parental right of custody, even if shared with the mother
3) that the country to which the mother has taken the child has signed the Hague Convention of 1980
